Special counsel Jack Smith quietly filed a motion to drop all four of the felony charges he brought against President-elect Donald Trump for the crime of telling the American people on Jan. 6, 2021, to peacefully protest, err, oops, to violently storm the U.S. Capitol and incite a riot. When asked why, he responded with tears in his eyes, “The plan failed. Trump won.” Then he ran into the woods to find the spot Hillary Clinton had discovered some years back, during her own post-presidential election binger, as prime wine-drinking property. And he cried and he cried and he cried.

Not really. But it could happen.

After all, with the case closed, Smith will have lots of free time on his hands.

“Smith and his team plan to resign before Trump takes office, one source told NBC News earlier this month. Special counsel regulations require Smith to file a report to the attorney general explaining his charging decisions before he steps down,” NBC wrote.

That might be a tricky dance move. How to word a completely fabricated list of felonies without appearing to have completely fabricated the felonious charges? The fact that the case is filed in ye olde storage cabinets in Smith’s private anti-MAGA sanctum under the category of “False-y McFalse Face” does not help. Not a good look, at least not in any sense of advancing a perception of unbiased.

What’s not perception is Smith’s record of failures.

Not only did he fail to convict Trump. Not only did he fail to jail Trump. Not only did he fail to prevent Trump from running a campaign for president. But he failed to keep Trump from winning. And anybody who’s anybody knows that a leftist and deep state failure to keep an enemy from winning is the absolute worst and most unforgivable sin of all — worse, in Democrats’ minds, than any of the 10 on that other guy’s list (you know the guy; the one Dems tried to remove from their party’s platform a while back).

“The move was an admission of defeat from Smith, who had already faced obstacle after obstacle in the two cases he has led since Attorney General Merrick Garland appointed him two years ago. The 2020 election subversion case suffered a setback after the Supreme Court ruled in July that past and future presidents could not be prosecuted for official acts taken while in office,” news website Intelligencer wrote. “In response, U.S. District Judge Aileen Cannon tossed the government’s other case against Trump, involving his retention of classified documents.”

And as Intelligencer also pointed out: “Those charges” — from the classified documents’ case, a.k.a. the Ridiculous Raid Of Mar-a-Lago case — were once thought to be the most open-and-shut among all the charges Trump has faced since 2020.”

Judge Cannon thought differently. Apparently. But Smith appealed.

Failure, meet epic.

The same day he moved to dismiss the subversion case against Trump — this, from MSNBC: “Smith moved to dismiss his appeal seeking to revive the classified documents case against Donald Trump.”

The holidays are shaping up well for the Trump clan.

“Though Trump could still be subject to state prosecution even while serving as president, the path to that outcome also appears to be narrowing,” Intelligencer wrote. “Last week, Juan Merchan, the judge presiding over the Manhattan hush money trial, officially took Trump’s sentencing hearing … off the calendar as Trump’s attorneys seek to have the matter dismissed entirely.”

Already, with the election, the adults seem poised to take back the political rooms. Soon, with the inauguration, it won’t be long for the adults to take back the judicial system. Then hopefully, America can get back to the business of being American again. America can resume a path of liberty and justice and equality — and perhaps, for Smith and his kind, maybe even accountability and consequences.
