Special counsel Jack Smith has asked a federal appeals court to pause his appeals of the documents-mishandling case against President-elect Donald Trump.

In a filing Wednesday with the 11th U.S. Circuit Court of Appeals, Mr. Smith sought a pause in the deadlines in his appeal of a Florida judge’s dismissal of the case on procedural grounds.

He made a similar filing with another federal appeals court last week in the other case he is pursuing against Mr. Trump — a case in Washington accusing Mr. Trump of conspiring to overturn the election.

According to Fox News, Mr. Smith plans to resign before Mr. Trump takes office on Jan. 20.

It has long been Department of Justice policy that a sitting president cannot be prosecuted.
