The announcement that Justice Ruth Bader Ginsburg died was very unfortunate news. However, I do not ascribe to the theory that she was a stalwart defender of U.S. constitutional law and a “judicial icon.” In fact, I believe there is ample evidence she was an enemy of the U.S. Constitution who never should have accepted her appointment to the court, and who thereafter should have been impeached.

On more than one occasion, Justice Ginsburg expressed her disdain for the U.S. Constitution. In an interview in 2012, she stated that she preferred the constitution of South Africa to ours. She said Egypt should “look at the constitutions of South Africa, Canada … and the European Convention on Human Rights.” Ginsburg stated her preference for “positive rights” over “natural rights.” Positive rights are those that government requires society to bestow on the recipient. These include education, contraceptives, medical care, food etc. She also declared that foreign law should be considered in deciding some cases. These statements were made after she swore to be “bound by oath or affirmation, to support this Constitution.”

Justice Ginsburg was known for decorating her judicial robes with neckpieces that signified her political opinions. The last thing a judge deciding a case of any kind should do is let their political views be known. I believe Ruth Bader Ginsburg should never have been appointed to the Supreme Court and should have refused the appointment because of her personal disdain for the U.S. Constitution. Her statements, on more than one occasion, were grounds for impeachment.
