TUCSON, Ariz. (AP) - Federal prosecutors again say they intend to seek the death penalty in the trial of a Tucson man accused of killing a U.S. deputy marshal nearly two years ago.

Authorities said Ryan Phillip Schlesinger opened fire in November 2018 as officers tried to serve a felony arrest warrant at his home on allegations that he stalked a Tucson police officer.

After a standoff with law enforcement that lasted about an hour, Schlesinger was taken into custody.

Schlesinger pleaded not guilty to 13 charges, including murder and assault on a federal officer.

His trial was scheduled to start in November 2019, but it has been delayed several times for various reasons.

The U.S. Attorney’s Office filed a superseding indictment against Schlesinger last Wednesday and he’s now set to be arraigned on Oct. 22 in federal court in Tucson.

Prosecutors have again filed an amended notice of intent to seek the death penalty against Schlesinger.
