WILKES-BARRE, Pa. (AP) - A defense attorney is seeking dismissal of a firearms count against a New York man charged in the shooting death of another man at a kindergarten graduation party the victim was hosting more than three years ago in northeastern Pennsylvania.
The (Wilkes-Barre) Times Leader reports that attorney Allyson Kacmarski argues in motions filed in Luzerne County last week that prosecutors should be barred from using 31-year-old Tremaine Jamison’s robbery conviction during trial. She said if testimony about the conviction is barred, the firearms count should be dismissed.
Witnesses told state police that a fight between the victim’s 6-year-old son and another child led to an argument between adults at the May 2017 party in Hanover Township near Wilkes-Barre. Prosecutors allege that the argument ended with Jamison, of New York City, shooting 29-year-old Devone Brown in the head.
