FALMOUTH, Mass. (AP) - The suspect in a fatal shooting on Cape Cod this week was spotted by a witness in an altercation with the victim before the shooting, prosecutors said.
Norman Dias, 32, of Mashpee, was held without bail at his arraignment Wednesday in Falmouth District Court after pleading not guilty to first-degree murder in the shooting death of Damian Anderson, the Cape Cod Times reported.
Mashpee officers reponding to reports of shots fired at about 11:30 p.m. Monday found Anderson, 45, of New Bedford, down in the middle of the road with multiple gunshot wounds. He was pronounced dead at the hospital.
Dias was found in the woods near the scene with a spent shotgun shell in his pocket, and was questioned but later released, prosecutors said.
But later, probable cause was established for an arrest warrant, and Dias was arrested Tuesday.
Defense attorney Ruth McLaughlin said Dias was not the shooter and that he just picked up the spent shell.
Dias is scheduled back in court on Aug. 20.
