NICHOLS, N.Y. (AP) - A tractor trailer driver accused of killing a New York transportation worker was found guilty of criminally negligent homicide.

Lawrence Faucett, 37, of Ulster, Pennsylvania was convicted by a Tioga County jury Friday in the March 2019 death of Dennis “Matt” Howe, 45, of Candor.

Howe was parked on the shoulder of Route 17 in an advance warning vehicle, authorities said. The lights of the truck were flashing to alert drivers of a road repair crew ahead.

Faucett drove his truck onto the shoulder and crashed into Howe’s truck, investigators said.

Howe was airlifted to a hospital and died several days later. He had been employed by the state Department of Transportation since 2006.

Sheriff’s deputies initially ticketed the Faucett for violating New York’s “Move Over Law.” After further investigation, he was later charged with criminally negligent homicide.
