The Supreme Court said Tuesday it will hear the case of a father who tried to sue a Border Patrol agent who shot into Mexico, killing his son.

The justices said they will try to decide whether a plaintiff living outside the U.S. can sue a federal employee for a violation of civil rights that also happened outside the U.S.

The family of Sergio Adrian Hernandez Guereca said Agent Jesus Mesa Jr. went “rogue” when he fired at a group of teens in a culvert on the Mexican side of the border, killing the teen.

Mr. Mesa said the teens were hurling rocks at him and the shooting was justified.

A review upheld his version of events, but the family disagreed and turned to the courts.

It’s the second time the case has been before the high court, which in 2017 heard arguments but sent it back to lower courts for more development of the facts — though the court called it “a disturbing incident resulting in a heartbreaking loss of life.”
