CARSON CITY, Nev. (AP) - Nevada’s appeals court says a 60-year-old former state prison inmate is eligible to recover the value of 48 days of good behavior credits that were taken from him without a hearing just a month before his release in 2015.
A 2-1 ruling by the state Court of Appeals sends Darryl Gholson’s civil rights action back to Clark County District Court for a damages hearing.
The Nevada Appeal first reported the ruling. It was issued Thursday, after Gholson argued the credits he earned were arbitrarily taken away.
The two judges said a judge in Las Vegas erred in agreeing with prison officials that Gholson had no constitutional rights to employment in prison or to parole.
The appeals court said Gholson had a “liberty interest” in the credits he had earned.
