BOSTON (AP) - A federal judge in Boston has ruled against a motion to dismiss an environmental lawsuit against a Cape Cod resort.

The Conservation Law Foundation’s suit seeks to impose tougher federal regulations on the Wychmere Beach Club in Harwich, alleging the resort violated the Clean Water Act by illegally discharging sewage into Wychmere Harbor.

The Cape Cod Times reports the foundation contends the resort is using a state permit for their septic system that does not reduce nitrogen and other nutrients.

The foundation contends a nutrient flow should be regulated under the much-stricter federal Clean Water Act.

The club previously filed a motion to dismiss, arguing the Clean Water Act didn’t apply to a septic system fully permitted by the state.

The club called it a “baseless suit.”
