CHARLESTON, W.Va. (AP) - A pay grievance filed by more than 270 Division of Highways employees is headed to mediation.

The Division of Highways had requested that the case be dismissed on the grounds that the grievance had not been filed timely, that it did not state a claim for relief, and that the employees lack standing to file a claim.

The Charleston Gazette-Mail reported on Wednesday that Chief Administrative Law Judge Billie Thacker Catlett rejected those motions, which means the case will move to a mediation hearing.

The employees filed the grievance in March, saying the agency failed to implement a new pay schedule required by a 2017 law directing officials to address ongoing hiring and retention problems through means that included developing a more competitive pay schedule.

A mediation date hasn’t been set.
