The Trump administration is considering whether to adopt a narrow definition of gender as biological, which would curtail the legal recognition of transgender people, The New York Times reported Sunday evening.

The Times obtained a memo from the Department of Health and Human Services that proposed recognizing gender as unchangeable and determined by the genitalia one is born with.

“Sex means a person’s status as male or female based on immutable biological traits identifiable by or before birth,” the memo read, according to The Times.

If the administration moves forward with this plan, it would be the latest in several policy changes affecting the transgender community, like the controversial policy that effectively excluded many transgender individuals from military service.
