PROVIDENCE, R.I. (AP) - The Rhode Island Supreme Court has allowed a man to seek a new trial in the 2009 shooting death of his teenage girlfriend.

The Providence Journal reports the court ruled Monday that 29-year-old Victor Arciliares’ request for a new trial had not been properly considered.

Arciliares is citing newly discovered evidence in his request.

He was previously convicted of second-degree murder in the death of Dayvelliz Cotto.

Arciliares testified the shooting was an accident, and he said the gun had gone off while the two looked at it in their apartment. Cotto is the mother of his daughter.

The judge countered Arciliares during sentencing, saying the shooting was based on anger and jealousy.

Arciliares is facing 45 years in prison and a consecutive life sentence.
