SAN FRANCISCO (AP) - A U.S. appeals court in California has revived a lawsuit accusing the governing body for water polo in the U.S. of ignoring repeated requests to implement a concussion policy for young athletes.
A three-judge panel of the 9th U.S. Circuit Court of Appeals ruled unanimously on Wednesday that USA Water Polo was responsible for protecting youth players from repeated head injuries. It rejected the organization’s claim that rules it implemented for coaches fulfilled that responsibility.
An email to a spokesman for USA Water Polo, Greg Mescall, was not immediately returned.
The suit was brought by a California mom, Alice Mayall, who said her daughter suffered a concussion during a water polo match in 2014, but was returned to play. Mayall said her daughter suffered a debilitating injury.
