SAN LUIS OBISPO, Calif. (AP) - Authorities say a former Paso Robles police sergeant won’t be charged with sexually assaulting a woman while on duty despite evidence that the two did have sex.
San Luis Obispo County District Attorney Dan Dow announced Thursday that there wasn’t enough evidence to prosecute Christopher McGuire and that no “reasonable” jury would convict him.
The county sheriff’s office had recommended charging McGuire with committing forcible sex acts.
The district attorney says there’s evidence that McGuire and the woman had at least consensual sex between last December and this March. However, other details haven’t been released.
McGuire resigned from the department last month.
An attorney for the woman, Ilan Funke-Bilu, tells the San Luis Obispo Tribune that his client is disappointed and he feels she’s being “re-victimized.”
