SAN DIEGO (AP) - A second jury has deadlocked on charges against a Mexican man who’d been deported 17 times when was involved in a crash that badly injured a 6-year-old boy.

The San Diego Union-Tribune reports that a judge declared a mistrial Monday after jurors said they couldn’t agree whether Constantino Banda Acosta caused the May 6 crash.

Prosecutors say Banda’s pickup ran a red light and hit the car of a family returning home after a trip to Disneyland.

The crash fractured a 6-year-old boy’s skull. His family says he’s still recovering.

Banda’s attorneys argue he wasn’t the one driving.

Banda pleaded not guilty to hit-and-run and DUI. Another jury deadlocked in the case in September.

The case drew national attention because of the number of times Banda had been deported.
