LAS VEGAS (AP) - A lawyer for a 26-year-old Las Vegas man facing child neglect, parole and gun possession charges says his client was asleep and did nothing wrong when his 2-year-old son was shot and killed by another child.
Defense attorney Doug Crawford asked a Las Vegas judge on Monday to let Michael Logan post bail and attend his son’s funeral.
Prosecutor Sam Kern countered that as a convicted felon in a 2013 battery case, Logan was prohibited from having a gun in his home.
The Las Vegas Review-Journal reports that the judge set a bail hearing Tuesday.
Police sought an involuntary manslaughter charge following the boy’s death last Wednesday, but prosecutors declined to file the manslaughter charge.
Authorities say the child was with four other children all under age 12 when the fatal shot was fired.
