BURLINGTON, Vt. (AP) - Opponents of the CityPlace Burlington project aren’t giving up even though a federal lawsuit has been dismissed.

A federal judge ruled last week that the lawsuit against the city of Burlington and developer Don Sinex was without merit.

Mayor Miro Weinberger tells the Burlington Free Press that he’s pleased by the ruling. But an attorney for the plaintiffs intends to ask the judge to reopen the case.

The lawsuit contended the city violated residents’ rights by modifying builder permits without any special notice beyond a routine posting.

The project has been stalled but Sinex announced says the project will be back on track in early 2019, with new finances in place.
