CHEYENNE, Wyo. (AP) - A 78-year-old Cheyenne man is facing a first-degree murder charge in the Dec. 5 shooting death of another man.

The Wyoming Tribune Eagle reports a judge ordered Charles S. Richmond held on $100,000 cash bond during a hearing Friday.

Richmond is accused of shooting 41-year-old John-Paul Birgenheier three times with a shotgun during an altercation over property.

Police say that when officers responded, Richmond approached one of them and said he was sorry.

Richmond’s attorney, Brian Quinn, asked Circuit Judge Thomas Lee to dismiss the case, saying the evidence was insufficient to show premeditated malice.

Lee said the evidence was enough to support the first-degree murder charge.

The investigation is still underway.
