WARWICK, R.I. (AP) - A judge has ruled a former candidate for governor of Rhode Island as well as a former attorney general candidate cannot get their marijuana back, saying it is still illegal even if they use it for religious services.
The Providence Journal reports that Warwick Superior Court Judge Bennett Gallo denied a petition of “habeas corpus Christi” from Anne Armstrong and Alan Gordon on Thursday.
The two are frequent candidates for office and are known for promoting a church that considers cannabis a healing drug.
They argue the term “marijuana” is racist, and Gallo referred to it as cannabis during the hearing.
Police say they seized 48 pounds of pot from the couple’s West Greenwich home in October.
Gallo ruled the marijuana is considered evidence in their pending drug cases.
