DALLAS (AP) - A panel of three judges with the 5th Circuit Court of Appeals in New Orleans has heard arguments on whether to embrace or reject a lower-court ruling that the Texas foster care system is unconstitutionally broken.
The Dallas Morning News reports the panel heard Monday from a top assistant to Texas Attorney General Ken Paxton and a Houston lawyer who is the lead counsel in the class-action lawsuit filed on behalf of youths in long-term foster care.
In January, U.S. District Judge Janis Graham Jack in Corpus Christi ordered a sweeping overhaul to the foster care system. Texas appealed her order.
The appeals court judges could rule completely in Texas’ favor, totally uphold Jack’s actions or take a middle course.
