SUDBURY, Mass. (AP) - The Massachusetts town of Sudbury has gone to court to challenge a lease between the MBTA and Eversource that would allow the utility to bury a power line below an inactive rail corridor.
The MetroWest Daily News reports that the suit filed in Land Court argues the agreement is illegal because it violates a legal doctrine that prohibits the repurposing of public land acquired for a specific public use without the passage of special state legislation.
Eversource agreed to pay the Massachusetts Bay Transportation Authority $9.3 million over 20 years for use of the land, and fund up to $4 million worth of environmental cleanup.
Eversource is still seeking state approval for its proposed nine-mile, 115-kilovolt transmission line between Sudbury and Hudson.
Eversource and MBTA spokesmen declined comment on the suit.
