CANTON, Mass. (AP) - Prosecutors are asking the highest court in Massachusetts to reconsider its recent ruling to vacate the conviction of a man caught outside a high school with a loaded gun in his bag.

The Supreme Judicial Court in a decision last month said police violated the constitutional rights of Jonathan Villagran when they searched his backpack. The Watertown man, then 19, had showed up outside Milton High School in 2015 without a legitimate reason to be there.

Norfolk District Attorney Michael Morrissey in a statement Monday that “there is room for additional analysis of the facts here.”

He said the court’s 5-2 decision “gives suspicious individuals who attempt to enter a public school greater protection than those students inside.”

Asking the court is reconsider a decision is unusual, but not without precedent.
