AUGUSTA, Maine (AP) - Maine’s highest court says it has overturned the indecent exposure conviction of a man who sent nude pictures to teenage girls.
The Portland Press Herald reports that justices ruled Thursday that Andrew Legassie’s five counts of indecent conduct should be overturned because he hadn’t exposed himself in person to the girls. State law qualifies indecent conduct as exposing oneself in a public or private place.
A lawyer representing Legassie argued a digital photograph didn’t “constitute an exposure.”
Two other convictions were also thrown out for violating evidence rules.
Legassie was convicted in 2016 of multiple sex crimes after contacting five teenage girls on Facebook.
Aroostook County Superior Court will now be asked to consider resentencing Legassie. He had originally been ordered to serve four years and five months in prison.
