SAN DIEGO (AP) - Court records show the father of two children who died in a California condominium fire had threatened a month earlier to burn down the condo that he and his estranged wife own.

The San Diego Union-Tribune reported Monday that 57-year-old Henry Lopez was seriously injured in the blaze and remains hospitalized. Police Lt. Mike Holden says investigators have not determined the cause of the fire, and that Lopez is not a suspect at this time.

Ten-year-old Cristos Lopez and 7-year-old Isabella Lopez died in the fire Saturday.

The newspaper cites documents that show Lopez’s wife requested a restraining order after he made the threats via text after she confronted him about missing a mortgage payment.

Attorney Wayne Rice, who represented Lopez when the restraining order was filed, had no comment on the alleged messages.
