Two teenage boys in Maryland — illegal immigrants — accused of raping and sodomizing a classmate in a high school bathroom skated charges Friday. Why?
Prosecutors dropped the case.
Lack of evidence, they said.
“Montgomery County State’s Attorney John McCarthy told a judge Friday that after an investigation, authorities are dropping rape and sex offense counts against 17-year-old Jose Montano, who was charged as an adult,” the Daily Mail reported. “He and 18-year-old Henry Sanchez, both of who were in the U.S. illegally, were charged in the alleged assault of the girl at Rockville High School in March.”
McCarthy also said his office was dropping charges against Sanchez, for the same reason — no evidence.
His statement, to reporters, was blunt: “The facts in this case do not support the original charges filed,” he said, the news outlet reported.
Both suspects still face charges tied to possession and distribution of child pornography, however.
The March arrest of the illegals sent a ripple through the national media, with some pointing to egregious nature of the crime as more cause for President Donald Trump’s crackdown on borders. A 14-year-old girl told police the two took turns raping her inside the boy’s bathroom.
But defense lawyers said in court the sexual incident was consensual, and that the girl’s claims weren’t supported by text messaging and video surveillance.
