PROVIDENCE, R.I. (AP) - A Superior Court judge says a former Rhode Island health director was justified in revoking a former state senator’s pharmacy license after he mistakenly gave morphine to two children.

The Providence Journal (https://bit.ly/2r2x8wv ) reported Friday a judge rejected claims by Leo Blais of Coventry that he was maliciously and selectively targeted, causing him to lose his license in 2013.

Then-state Health Director Michael Fine permanently revoked the license after Blais gave morphine to an infant and toddler, who became lethargic.

Judge Daniel A. Procaccini wrote how, “but for a miracle, Mr. Blais’s error did not have deadly consequences” and that Fine’s actions were “tied to legitimate state interests in public health and safety.”

The judge also rejected claims by Blais that his due process and equal protection rights were violated.
