HOUSTON (AP) - A Harris County grand jury has declined a capital murder indictment against a Houston man whose 2010 videotaped beating by police was cited by activists as an example of police brutality against minorities.

Chad Holley was accused of fatally shooting 42-year-old David Trejo-Gonzalez in a robbery outside the man’s apartment last September.

Prosecutors say if other substantive evidence emerges, the case could be considered again by a grand jury.

When initially charged, he already was in custody for other offenses.

In March 2010, Holley was 15 when he was caught as a burglary suspect. A business security video showed officers appearing to kick and beat him. Holley was convicted of burglary and four Houston officers were indicted on misdemeanor charges. Two pleaded guilty, one was convicted and another was acquitted.
