LINCOLN, Neb. (AP) - A man and woman have been sentenced in the fatal shooting of a Lincoln man last year.
Matthew Pavey, 26, was sentenced Tuesday to 75 years to life in prison for shooting and killing James Carr, 27, the Lincoln Journal Star (https://bit.ly/2lbHisU ) reported. Tiffany Welch, was also sentenced 15 to 20 years in prison for her role in the crime.
Police said Carr was found dead in an alley Jan. 4, 2016 and that Welch lured Carr to the location, where Pavey shot him.
Welch was charged with attempted robbery and Pavey was charged with second-degree murder. Last month, both pleaded no contest to the crimes.
Deputy Lancaster County Attorney Jeff Mathers said the victim was shot five times. He noted Pavey was out of jail on bail when he allegedly shot Carr.
Welch’s attorney, Rob Kortus of the Nebraska Commission on Public Advocacy, said Carr and Pavey had a fist fight in December 2015. He also said Carr had written about the fight and how it ended on social media.
“It was just a matter of time before those two were going to fight again,” he said.
Kortus argued that there was no suggestion Welch wanted to kill anyone.
Pavey apologized in court for what he called “tragic circumstances.”
“There’s no way I can make it right for the people that were affected,” he said.
Mathers said Pavey didn’t take responsibility for the crime, after his written letter to the judge claimed the shooting was a matter of self-defense and that Carr was the aggressor.
Lancaster County District Judge Andrew Jacobsen said the evidence presented showed a premeditated robbery.
“To me, that shows evidence of premeditation,” he said.
