PHOENIX (AP) - Arizona’s pension plan for judges and other elected officials is asking the state Supreme Court to reconsider its ruling that says making judges pay more into their pension plan is unconstitutional.
The motion filed last week by the Elected Officials’ Retirement Plan and joined by the state asks the court to overturn its November ruling. The court said the state Constitution’s ban on diminishing promised pensions bars the actions.
The Legislature passed the law in 2011 that also included changes in yearly retirement pay increases.
Judges in office when the law took effect sued.
Justice Clint Bolick and four lower court judges who the law doesn’t impact issued the decision after four justices covered by the law declared conflicts.
Pensions for new judges and elected officials were eliminated in 2013.
