BURLINGTON, Vt. (AP) - Attorneys for Burlington and a proposed mall development say a lawsuit challenging a voter-approved funding plan to reopen two streets around the Burlington Town Center should be thrown out.
The lawsuit seeks to overturn a vote that authorized the city to borrow up to $22 million to reopen Pine and St. Paul streets.
The suit alleges voters weren’t properly informed when they passed the tax-increment financing plan.
The Burlington Free Press reports (https://bfpne.ws/2k2H8SJ ) city attorneys responded last week by saying the suit is largely based on a misunderstanding of funding statutes. They say voters received plenty of notice and were educated on the issues.
Lawyers for developer Don Sinex say the complaint “alleges a hodgepodge of procedural challenges,” none of which explain the Town Center’s legal role in the suit.
