SALT LAKE CITY (AP) - A judge has refused to dismiss the case against a Utah County man whose conviction of killing his wife was overturned.

The Salt Lake Tribune reports (https://bit.ly/2j5OKno ) 34-year-old Conrad Mark Truman is scheduled for a new trial next month. He’s charged with murder and obstructing justice in connection with the 2012 death of his wife, Heidy.

Truman was convicted of the crimes in 2014. But a judge ruled in August that he should get a new trial because inaccurate measurements of the Truman house wrongly undermined the defense theory that Heidy Truman fatally shot herself.

Truman’s attorneys then asked for a complete dismissal of the case, claiming police and prosecutors allowed false testimony at trial and covered up mistakes.

But 4th District Judge Samuel McVey denied the claims and ruled that any errors have already been remedied through granting a new trial.
