SALT LAKE CITY (AP) - A Utah man charged in the death of a sheriff’s deputy has testified for the second time that it wasn’t him but the officer’s brother who fired the fatal shots.

The Salt Lake Tribune reports (https://bit.ly/2kbaDBx) 44-year-old Roberto Roman took the stand Friday.

He was charged in federal court with killing a law enforcement officer after a state jury acquitted him on aggravated murder charges in the death of Millard County Sheriff’s Deputy Josie Fox.

Roman says he had smoked methamphetamine with Ryan Greathouse and the two were in a car together when Fox stopped them in 2010.

He says Greathouse took an assault rifle and fired the shots in the dark. Greathouse died shortly after his sister and was never formally accused.

Prosecutors say Roman killed her with assault rifle aimed over his shoulder.
