BOSTON (AP) - Massachusetts’ highest court has reinstated weapons charges against a man charged with murder in the fatal shooting of a 17-year-old boy in Boston.
The Supreme Judicial Court issued the ruling Thursday in the case against 19-year-old Alexander Soto.
In 2015, the then-17-year-old Soto and two men were charged in the November 2014 killing of Ryan Morrissey and wounding of another victim. Soto was charged as an adult.
A Superior Court judge had dismissed the weapons charges, ruling that because of Soto’s age, prosecutors had to first bring those lesser counts in Juvenile Court. Suffolk County prosecutors appealed the decision.
The Supreme Judicial Court’s decision Thursday says that state law “eliminates the role of the Juvenile Court in the prosecution of juveniles charged with murder.
