ATLANTA (AP) - A prominent Atlanta attorney accused of murder in the fatal shooting of his wife wants a judge to let him visit his dying mother in Texas.
The Atlanta Journal-Constitution reports Claud “Tex” McIver filed a motion asking a judge to let him visit his 98-year-old mother, who is in hospice. The judge said he would review it and respond next week.
Atlanta police have said McIver was riding in a rear seat of an SUV late Sept. 25 when a gun he was holding fired and the bullet hit his wife, business executive Diane McIver.
McIver faces charges including malice murder. He has said the shooting was an accident.
During a hearing Friday, McIver’s defense team also focused on trying to suppress evidence seized during searches.
