JACKSON, Miss. (AP) - A federal appeals court has removed a judge from a long-running lawsuit that Mississippi Attorney General Jim Hood filed against Entergy Corp.
The Clarion-Ledger reports (https://on.thec-l.com/2dnMcwX ) that the 5th U.S. Circuit Court of Appeals cited U.S. District Judge Henry Wingate’s failure to rule on pending motions in removing him from the case last week.
Hood said in a court filing that reassigning the case to another judge was the “only viable option” given that the litigation has been pending for eight years.
Hood’s suit claims the New Orleans-based utility and its subsidiaries illegally manipulated the purchase and the sale of electricity to maximize profits. Entergy has denied Hood’s claims.
