BOSTON (AP) - Massachusetts’s highest court has tossed the conviction of a former Wareham man found guilty in 2014 of raping his daughter more than 30 years ago.
The Boston Globe (https://bit.ly/2e7RfCX ) reports the state Supreme Judicial Court on Wednesday ruled that Robert White’s child rape conviction couldn’t stand due to an issue related to the statute of limitations.
State law allows defendants to be convicted of child rape for incidents that happened more than 27 years prior to indictment if there’s corroborating evidence.
The court says White’s daughter testified at trial to some “incidents of rape” that occurred before Oct. 3, 1981 and some after that date.
It found that prosecutors failed to provide corroborating evidence for incidents before that date, and the jury may have convicted White based on those incidents.
