HOUSTON (AP) - A federal agency that enforces laws against workplace discrimination is accusing a Houston nightclub owner of improperly firing a waitress because she wouldn’t provide health records to disprove rumors she has HIV.
A federal judge has set a Dec. 6 hearing on the Equal Employment Opportunity Commission’s lawsuit against Leila Roberts, owner of Diallo’s nightclub.
The commission says the waitress, who is not HIV-positive, qualifies for protection under the Americans with Disability Act because of the club’s assumption that she has a disability. The EEOC’s Houston district director, Rayford Irving, tells the Houston Chronicle (https://bit.ly/2eaCj7t ) it’s unfair and unlawful to force an employee to prove she doesn’t have an ailment.
An attorney for the club, Ray Shackelford, did not immediately respond to a phone call Monday from The Associated Press.
