ROCHESTER, N.H. (AP) - A man has been jailed without the possibility of bail after authorities say he sold a fatal dose of fentanyl to a Rochester man over the summer.

The judge on Tuesday upheld a no-bail order for 27-year-old Ryan Kirk, who had been arrested over the weekend on a charge of dispensing a controlled drug with death resulting. He faces up to life in prison if convicted.

Kirk’s lawyer didn’t challenge the order. A request to review the decision can still be filed.

Court documents allege Kirk sold drugs to the victim at a Rochester apartment where Kirk was living. A friend of the victim said he saw the transaction and the fatal overdose.

Prosecutors say Kirk pleaded guilty last month to unrelated drug charges and received a suspended prison sentence.
