JONESBORO, Ga. (AP) - Autopsy results show the drowning death of disabled boy in suburban Atlanta was an accident.

The Atlanta Journal-Constitution (https://on-ajc.com/2dgLCB7 ) report the Clayton County Medical Examiner’s Office released the results Friday after Michael David Smith was charged with murder in the death of Ty Lee in June. Smith lost his job with the Clayton County school district last month.

Smith was an elementary school teacher at Roberta T. Smith Elementary in Rex.

Smith was also charged with child cruelty after Lee drowned in the bathtub while he tended to his three other children. Lee was autistic and used a wheelchair.

The boy had no physical marks or signs of abuse when police arrived.

Smith’s lawyer Marsha Mignott says police and prosecutors should’ve waited until the autopsy report returned. Smith has no prior criminal history.
