HAPEVILLE, Ga. (AP) - A Decatur man is suing the Hapeville Police Department after he says he was arrested and jailed for nearly two months for an armed robbery he didn’t commit.
The Atlanta Journal-Constitution (https://bit.ly/2figp2J ) reports 23-year-old William Henry Miller was arrested for armed robbery and cruelty to children in 2015 and spent 53 days in jail. The charges were dropped in March after the victim didn’t identify him as the man who held her up.
Miller’s now suing the city and the police officer who arrested him. Attorney Harold Spence called Miller’s arrest a “deliberate act of wrongdoing,” as the officer swore to the court that the victim had identified Miller as the armed robber, even though she hadn’t seen his photo.
Hapeville police and city officials didn’t return calls seeking comment.
