The Obama administration will issue a decree Friday telling all the nation’s public schools that they must let transgender students use the bathroom of their choice — or else.

According to The New York Times, the letter from the Education and Justice Departments will outline what schools must do to avoid discriminating against transgender students.

“A school may not require transgender students to use facilities inconsistent with their gender identity or to use individual-user facilities when other students are not required to do so,” according to the letter, The Times reported.

The DOJ/DOE letter does not technically bind the nation’s schools, which are creatures of state and local governments. But it clearly sets out the Obama administration’s view of what federal antidiscrimination laws require and thus threatens them with lawsuits if they do not comply, the Times reported.
