HILLSBOROUGH, N.C. (AP) - Federal authorities say a man charged in a construction accident that killed a boy has been in the country illegally.

Alejandro Suarez, 28, appeared in court Wednesday on a misdemeanor charge of death by motor vehicle. Authorities say he left a construction truck unattended at a residential Hillsborough worksite, and it rolled down the street and killed a 5-year-old boy.

Media outlets report U.S. Immigration and Customs Enforcement issued a statement saying Suarez has been in the country illegally and had a 2009 conviction for impaired driving. Federal officials issued a detainer that would allow them to take Suarez into custody later. Authorities say Suarez is from Mexico.

Defense attorney Bill Young says Suarez is devastated by what happened.

Hillsborough authorities are working to determine which building contractor Suarez worked for.
