HILLSBOROUGH, N.C. (AP) - An arrest warrant says a man charged in the death of a 5-year-old Hillsborough boy killed when a construction truck hit him had left the engine running without the parking brake engaged correctly.

Multiple media outlets reported that the warrant says 28-year-old Alejandro Suarez of Angier left the truck unattended, with the engine running and “without … effectively setting the parking brake.”

Suarez is charged with misdemeanor death by motor vehicle in the death of Everett Copeland on Monday. The truck rolled into the Copeland family driveway, hitting the child and smashing into the house.

Suarez made his first court appearance on Wednesday. After the hearing, defense attorney Bill Young described Suarez as an “awesome kid” and said he is devastated by the tragedy.
