MIAMI (AP) — A judge will consider a lawsuit filed by two Cuban-American men against Carnival Corp. over its planned cruises from Miami to Cuba.

A status hearing Thursday comes after Carnival announced it will allow Cuban-born people to book passage on the trips set to begin May 1. Cuba prohibits its nationals to return to the island by sea, and Carnival says it will delay the cruise if that policy does not change.

The lawsuit challenged Carnival’s previous adherence to the Cuban policy as discriminatory. Attorney Tucker Ronzetti says a judge’s order may be necessary to make sure Carnival’s latest decision remains in place.

The May 1 cruise by Carnival’s Fathom brand would be the first such sail in more than 50 years between the two countries.
