NEW ORLEANS (AP) — A federal appeals court is again considering whether Mexican parents may sue the United States and a Border Patrol agent who shot and killed their son from across the border.
The full 16-judge court heard arguments Wednesday from attorneys for agent Jesus Meza Jr. and the parents of 15-year-old Sergio Hernandez.
A three-judge panel of the 5th U.S. Circuit Court of Appeals ruled in June that Jesus Hernandez and Maria Guadalupe Guereca Bentacour could sue Meza. That overturned a district judge’s decision.
Meza won a rehearing by the full court.
The panel upheld District Judge David Briones’ ruling that the teen’s parents cannot sue the United States or Meza’s supervisors.
The family wants the full court to reconsider one of several arguments it had made for suing the federal government.
