SPRINGFIELD, Mass. (AP) - A Springfield man whose second-degree murder conviction for killing a 19-year-old woman was overturned has been sentenced to up to 17 years in prison for involuntary manslaughter.
The Republican (https://bit.ly/1nYrUqD ) reports that Daniel Horne was sentenced Wednesday in the 2009 fatal shooting of Brittany Perez.
Authorities say the 31-year-old Horne fired eight rifle bullets into Perez’s home, hitting her in the head, because he thought someone there had stolen his TV.
A jury found Horne guilty of second-degree murder in 2011, and he was sentenced to life in prison.
But the Supreme Judicial Court in September overturned the conviction, saying the trial judge erred in not instructing the jury on involuntary manslaughter.
Prosecutors could either have Horne sentenced on the lesser offense or seek a second trial on second-degree murder.
