COLUMBUS, Ohio (AP) - The last abortion clinic left in Toledo has taken another legal step in its struggle to survive.
Capital Care Network filed a legal brief with a state hearing officer this week arguing that it’s appropriate under a new Ohio law to have a transfer agreement with a hospital that’s more than 50 miles away in Ann Arbor, Michigan.
The clinic is fighting a state order that it close because it lacks a required transfer agreement with a “local” hospital. The clinic is arguing that the University of Michigan Health System hospital in Ann Arbor qualifies as a “local” facility.
The brief argues that the law is vague because it doesn’t specify what is meant by “local.”
The hearing officer is expected to make a recommendation next month.
