JACKSON, Miss. (AP) - A 46-year-old Lowndes County man convicted seven years ago of assaulting a Lowndes County sheriff’s deputy has been granted a new trial.
The state Court of Appeals on Tuesday ordered the new trial for Steven Yarbrough after finding his attorney, Rod Ray, had a conflict of interest.
The court says Ray shouldn’t have been representing both Yarbrough, and Clint Sims, the deputy Yarbrough was convicted of choking during an arrest in 2006.
The court says Ray did not disclose the conflict until the day Yarbrough went to trial and said his friendship with the deputy actually might help Yarbrough’s case.
Yarbrough was convicted and sentenced to 30 years as a habitual offender.
