PHOENIX (AP) - Arizona Attorney General Tom Horne has been given more time to pay back $400,000 in donations for his 2010 campaign for office.

An agreement between Horne and Yavapai County Attorney Sheila Polk will delay the payment requirement until an appeal in the campaign finance case is resolved.

Polk last week reinstated the case after an administrative law judge decided accusations should be withdrawn due to lack of evidence. Horne will now appeal to Superior Court.

Prosecutors allege Horne and aide Kathleen Winn illegally worked together on outside ads targeting Horne’s Democratic opponent before the November 2010 election. She ordered him to repay $400,000 and amend his campaign finance reports. He and Winn also could face up to $1.2 million in fines, three times the amount Polk says was improperly spent.
